I might come out okay. Mazda called a few minutes ago...they suspect actuator went bad, caused overboost and then BOOM! I am under factory warranty, which I thought would be voided (and still might end up), cause of my boost controller, but that came up missing....hummm;) ? Wonder where it went? Never know.. Oh well. But they are looking for a reason not to warranty it I am sure. I will keep everyone informed.

Glad you left the dark side of the 24/7 forums! The Street Unit guys are great as are the members here! We took a trip down to Orlando just to hang with them and we'll be back again for Sebring as well.

Make sure you get your aftermarket parts for the Spicy from them, the SMIC intercooler is sweet, 1000 times better than the stock! Also get a pair of their motor mounts, the front and rear. My next project is the hard pipes and a BOV, followed by their S-Pipe.

You can't go wrong, hopefully you get your Spicy sooner than later.

Haven't heard from Mazda yet. Very nervous. They mentioned this stuff on Monday:
Can anyone answer this: Could any of these mods void a factory warranty?
1) Injine Cold Air- Injine said no but Mazda mentioned it.

2) Catless Exhaust and no rear o2 sensor.

3) Front Mount Intercooler- I do not have one but they found evidence of one being on cause the core support was notched out. News to me.

Raider

Those are all mods that they have to prove caused the detonation. Magnussen Moss Act describes that in detail. Essentially, they have to prove how that modded part caused the failure. If the Injen sucked in water and popped the block because of that, they, that voids the warranty. Nothing so far has a reason to void the warranty imo.

Got the call. WARRANTY HAS BEEN VOIDED DUE TO CATLESS EXHAUST. Now what type of sh*t is that. Here's the kicker...I bought it 5 months ago from a Masarati Dealership without cat which I found out was illegal to do in Ohio. I had a meeting at the Masarati/Toyota Dealership a few minutes ago and told them what was up. They called Mazda and had it out on the phone with them. I told them my intentions to file lawsuit for selling a car illegally. They said hold off and they will call me today to try to resolve this issue. So I am back in limbo again. I am familiar with The Moss Act. Hope it comes through.

Raider
02-01-2007, 11:46 AM
Well, now it is up to Mazda to show how relieving backpressure caused it to pop. The fact you got it modded should fall back on the one dealer selling it with illegal parts and equipment.

Sorry man.

It is funny. Mazda was surprised I knew about the Moss Act. I stirred up a crap storm this morning. I just got off the phone with Mazda USA and explained what was going on. They agreed about the Moss Act and the stealership had to prove the catless exhaust caused the detonation. They say said # 3 rod was bent and piston slammed into the head. Needs a long block and a new turbo kit. Coolant made it's way into the turbo through the oil feed lines. Total bill: $8800 + tax. Of course I am not going to pay that. I will push it home or to a mechanic elsewhere. I am waiting to hear back from them again.

Raider

Right now they are refusing warranty cause of the catless exhaust . They can't explain how. I had an arbortration meeting today with the district manager of Mazda. I was shot down in less than 5 minutes. I have one more option to try. If not, get a motor warmed up for me Street Unit!

If anything, a cat-less exhaust which causes less back pressure may burn an exhaust valve, but honestly don't know how you would bend a rod. Would love to see documentation of how that could happen, not that it couldn't, but would like to see it. PM Mr. KA-T and see what he thinks, since he is a Mazda tech.

First off..hello and welcome to the forum..great bunch of guys around here..sure you'll agree.

Anyway, been following your story and it seems pretty simple you shouldn't be the one fighting with mazda, this should be on the dealers tab and trust me these guys have lawyers..no problem. The thing is they won't want to get these all messy with the law, in the end you should end up getting this all taken care of via the dealships expense.

I take it your dealing the the top dog at the dealer who sold you the modded car, if not then do so. Next simply bring up the facts and ask what would cost more them paying to fix the car or having a news story done about how the dealership is in the habit of selling cars without looking at them...either way they are screwed and mazda knows it too.

I think if you pull the right string things will get worked out, I would most certainly not let this go and let mazda or this other dealer slip away without taking care of this...time consuming as it may be...staying the coarse will pay off.

Last resort is to get a lawyer, quite sure he could get his fees paid for along with getting your car rebuilt.

Best of luck.

I decided to leave Mazda alone and go after the dealer that sold me the car. It was a Masarati/Toyota Dealership. I have talked to the service manager and he said he will work on it. You are kidding! They retired the 14?? That is some bull. I had no idea. To me the 14 is a symbol of the Navy. I couldn't fly it cause I didn't have perfect vision. Last year I went to sign up for the National Guard. They were going to place me at in an "Army Morgue" in Iraq. Then they found out I had a disqualifier. I have 5 or more dependants. damn, 5 kids? I'm strugglin to not have one. eek. ya they just did the official retirement ceremony down in Virginia Beach in Sept. They were just getting too old (it took almost 36 maintenace hours per flight hour). But really, all they needed was an updated version. But Clinton and his unlogical thoughts decided that he wanted to just replace the bad ass aircraft with an updated F/A-18E/F superhornet which is slower, can't fly further, nor carry the payload of the F-14. He just wants the navy based primarily on two aircraft, 18's and sh-60's, which in theory covers all the missions of the other aircraft.

Yup..5 kids. I have an 11 month old girl and a 6 year old boy here at home. I also have a 12 year old(boy), 10 year old(girl) and 9 year old(boy) that don't live with me. I just turned 28 in December, so do the math. I started young. But I had a vasectemy last year, so no more kids for me. :) Should of had that surgery when I was 15.
Yeah, I agree, they needed an updated version of the Tomcat. It could be done. My second jet I wanted to fly was the F15 Eagle, which of course is Air Force. Are you land based or carrier and what is your job. My friend is on the aircraft carrier JFK or Eisenhower. Not sure. He is an aircraft mechanic.

Heard back from Toyota this morning. They offered to put in a used motor with 51,000 miles from a salvage yard. I told them no. I said "brand new long block" nothing less. I also talked to the Federal Trade Commission this morning and filed a complaint. Toyota said they would get back to me. I told them TODAY cause I have waited long enough. I think I won this one. The FTC said they did break the law. They tried to low ball me with some used junkyard crap. Not today.

Then I had a good long talk with the Federal Trade Commission. They were especially interested. Well, about 2 p.m. I got a call from Toyota/Masarati asking me to come in for a meeting. I did. They apologized for not catching the flaws in the car. They agreed to fix it right with the right emissions installed on it. They said they would have it for 3 to 4 weeks. The motor was ordered today. On top of that, they offered me a rental car for free until my Speed was back in my hands. They gave me a red 2007 Toyota Corrolla S. :) Pimp Status!

More and more parts are being developed for this car, as of right noe CPE's MAfci intake, they also have headers for it, there is a are a couple of motormounts, SU's being one of them. Also, Racing Beat and Mazdaspeed have aftermarket accesories too.

I wonder if it is used, passing it off as rebuilt once they got sticker shock of the cost for a new one.

Oh, I am. I showed up there unexpected and caught them off guard. I mentioned it didn't look brand new(even though it is very clean). I don't know much more than that until I talk to this guy. They are going to warranty this motor for 11,000 miles they said. I am getting frustrated with this whole thing. The tech working on it called off today, so no more work is being done right now.
